[A]s contradistinguished to natural law, or to the law of nature (meaning, by those expressions, the law of God), the aggregate of the rules, established by political superiors, is frequently styled positive law, or law existing by position. 実定法は、 自然法と対比して語られることが多い。 自然法の考えを支持する人によれば、 この法は、あるべき法、すなわち、 実定法を批判し、実定法を基礎づける法、 イデアとして存在する法である。 もちろん現実の法に対して理想的な法を想像するのは自然なことだが、 この理想の法が現実の法に対してどういう関係を持つのか、 という問題は、 自然法論者と法実証主義者の論争の的である。
