道徳的権利

(どうとくてきけんり moral rights)

私の考えでは、道徳的権利という考え方は、 より基本的な道徳的考慮のことを語るための速記的表現として 使われるなら意味があるが、そうでない限りは役立つ表現でも なければ有意味な考え方でもない。

法によって生み出される法的権利とは異なる、 道徳上の権利。 かつては自然権と呼ばれた。

ファインバーグからの孫引きだが、 レイモンド・フレイは次のように定義している。 「[道徳的権利とは、] 共同体における立法や社会的慣行の産物ではないものであり、 それを否定するような立法や慣行に直面した場合でもしぶとく生き残り、 さらに、 個人にしろ共同体にしろ、その全体的な目的の追求に当たって、 踏み超えてはならない境界を定めるような権利のことである」 (Joel Feinberg, Freedom and Fulfillment, Philosophical Essays, Princeton UP, 1992, p. 200)

これに続けてファインバーグは、 道徳的権利が、法的権利と異なるだけでなく、 慣習道徳によって成立するような権利とも異なることを強調している。 すなわち、道徳的権利は、 法的権利や慣習道徳による権利を批判し基礎づける「真の」権利なのである。

ファインバーグの用語に従って、 実定道徳(慣習的道徳、常識道徳)において認められている道徳的権利を 慣習的な道徳的権利と呼び、 実定法や実定道徳を批判する基準としての道徳的権利を 批判的な道徳的権利と呼ぶといいかもしれない。 この場合、後者が自然権に当たる。
