主権者命令説

(しゅけんしゃめいれいせつ the sovereign command theory)

法あるいは道徳は、 究極的には主権者(たとえば王さま)の命令に 他ならない、とする立場。 「だってお父さんが言ったんだもん」 というのがこの立場を端的に示すセリフである。

この立場は、法や道徳を、 ギャングが銃を頭に突き付けて「手を上げろ」という脅迫と似たものとみなす。 すなわち、 法は、この脅迫に比べてもう少し一般的なだけで、 基本的には「主権者による脅迫(刑罰)をともなった命令」である。

この立場は、「法あるいは道徳は神の命令である」 とする神の命令説とよく似ている。

ジョン・オースティンは、 実定法(現に通用している法)は「主権者の命令である」と考え、 実定法や実定道徳の批判に用いられる あるべき道徳は「神の命令である」と考えた。 (さらに、オースティンの場合、神は被造物の幸福を願っているので、 神の命令は結局のところ功利原理によって 知られることになる。) このとき、ギャングの脅迫が神の命令に基づく必要がないのと同様に、 主権者の命令も神の命令に基づいている必要はない。それゆえ、 たとえ道徳に反した法(たとえばナチスの法)でも、 法であることにはかわりない、ということになる。
