判例法

(はんれいほう common law)

The real and lasting Benthamite revolution in legal thinking derived from the attack on the common law for its lack of clear rules as wel as for the sinister interests which sustained it. The French Revolutionaries - Bentham's contemporaries - likewise wanted codified rules of law because the old reliance on principles, doctrines, standards etc. left too much discretion to the judiciary.

立法府が作った法典(刑法典、民法典など)に基づく 法体系(大陸法 civil law)ではなく、 裁判所の判例を寄せ集めてつくった法体系のこと。 不文法(成文化されていないということ)、コモン・ローとも呼ばれる。 英米法は判例法を基礎としている。

ベンタムは判例法を 裁判官の恣意的判断を許すものとして忌み嫌い、 死ぬまで批判しつづけた。
