(せいぎ justice)
正義について語るということは、己れの生をいかに形成すべきか迷い悩む青年 に道を示してやることではない。ポルノ雑誌や漫画はやめて法哲学の論文を読 みなさいと学生に説き勧めることではないし、男の愛すべきは女であって男で はないとサンフランシスコへ行ってお説教することでもない。正義の追求とは 求道の情熱を満たしたり、迷える羊を強引に群れへ引き戻したりすることでは なく、例えば、小学生の視野にも割り込んでくるような街角に氾濫するセック ス産業の広告は寛大に放置しておきながら、一人楽しむために買ってきた外国 のポルノ雑誌を税関で厳しくチェックするのは正当な権力の行使と言えるだろ うかとか、同じ国土に定住して税金も納めていながら、外国人であるという理 由だけで指紋押捺と登録証の携帯を義務付けるのは公平かとか、そういったよ うな問題について考え、議論することである。即ち、正義とは人々が強制によっ てでもその実現へと嚮導さるべき「善き生」についての唯一の正しい理想のこ とではなく、善き生についての自己の解釈を生きることにより自己の生を意味 あらしめようと努める各人の自由が、他者の同様な自由を侵害することなく実 現され得るための条件を構成する価値である。この意味における正義は人生の 意味・目的としての善から概念的に区別されなければならない。

もっとも一般的に言えば、正義とは、 「各人に然るべきdueものを与えること」 と説明される。 刑罰などについて言われる応報的正義は、 「各人の功績につり合った賞罰を与えること」であり、 資源の配分について言われる配分的正義もやはり、 「各人の功績(価値)につり合った配分を行なうこと」である。 問題は、 「然るべき」や「功績」という考えがあいまいであるから、 これらに対して明確な基準を設けなければならない、 ということである。 つまり何をもって「然るべき」とするのか、 何をもって「功績」とするのか、を決めなければならない。 そうしなければ、「各人に然るべきdueものを与えること」 は内容がない説明に終わってしまう。 (11/12/99)
